Abstract

Appointment to senior positions in the state is a matter of great importance, as it is linked to the success of the government and the delivery of services to citizens in a satisfactory manner. To be filled, or the texts in which the competence of appointment is granted to the heads of parliaments, and according to the political and constitutional system of the state as well. Some of them are done by the President of the Republic, and others are reserved for the head of government and the legislative or judicial authority, so we talk in this research about the legal constitutional system for assuming high positions and those who have the right to be appointed in both Algerian legislation and Iraqi federal legislation, and that is in two demands, we devote the first requirement To talk about the legal constitutional system for assuming senior positions in Algeria, as for the second requirement to talk about the legal constitutional system for assuming senior positions in federal Iraq.
